No smoking policy

1. All vehicles on ABC AUTOCARS are non-smoking vehicles.
ABC AUTOCARS prohibits clients, their passengers, driver, and additional drivers from smoking in any vehicle listed on ABC AUTOCARS. ABC AUTOCARS provides clients with a smoke-free vehicle.
Renter, driver, additional driver, and their passengers may not smoke in any vehicle, even if they believe a previous renter may have done so.
ABC AUTOCARS’s no smoking policy covers the use of, but isn’t limited to, any tobacco or tobacco-related products, marijuana or marijuana substitutes, e-cigarettes, or personal vaporizers.
⚠️ Florida marijuana driving laws prohibit smoking or ingesting medical marijuana in public places or in a vehicle. Driving while under the influence of marijuana is still illegal, and you should never use marijuana in a booked car or before driving.
🛑 🚭🌿 If ABC AUTOCARS detects any cannabis (marijuana) odor inside the vehicle, ABC AUTOCARS will immediately file a police report and notify the Department of Health.
📄✔️ Renter acknowledge that they received the vehicle without any odor of cigarettes, tobacco or tobacco-related products, marijuana or marijuana substitutes, e-cigarettes, or personal vaporizers. If the client does not report any smoke-related odor or issue to ABC AUTOCARS immediately at check-in, they may be held responsible for that condition upon return.
2. Violations
Neither you nor your passengers, driver, or additional driver may smoke in any vehicle subject to the terms and conditions applicable at the time of the rental.
If ABC AUTOCARS determines a smell of smoke inside a car, any type of cigarette smoke, any type of tobacco or tobacco-related product smell, any type of Cannabis (Marijuana) smell, or if smoke has settled on car interior surfaces, or there is physical evidence of smoking, ABC AUTOCARS will charge you a $500 violation fee plus an additional 4.5 % process fee and remove you from ABC AUTOCARS. This is a per vehicle charge.
💰⚠️ Additional fees may be assessed depending on the extent of smoke-related damage or contamination to the vehicle.
3. Evidence of Smoking
ABC AUTOCARS determines smoking through any combination of the following forms of evidence:
• Detection of smoke odor inside the vehicle during the post-rental inspection
• Physical evidence such as ashes, cigarette butts, burn marks, residue, or vaping devices
• Visible nicotine, smoke film, or vapor residue on interior surfaces
• Pre- and post-rental photographic or video documentation confirming a change in the vehicle’s condition
• Failure by the renter to report any smoke odor, residue, or related issues at pickup or within a reasonable time after the start of the reservation
• A written confirmation or inspection note from any detailing company, car wash, or ABC AUTOCARS staff member confirming the presence of smoke odor, residue, or smoke-related contamination
Any one or more of these forms of evidence shall be deemed sufficient to establish a smoking violation.
